Official Rules
1. ELIGIBILITY: The GORE-TEX® Footwear Diamond in the Rough ("Contest" or "Promotion") is open to all legal residents of the 50 United States and the District of Columbia, who have reached the age of majority in the state where they reside and who have a valid driver's license. Employees, officers, and directors of W. L. Gore & Associates, Inc. ("Sponsor"), its affiliates and subsidiaries, advertising, promotion and fulfillment agencies, web masters and web suppliers, and the immediate family members (spouse, parents, siblings and children and their spouses and in-laws) and persons living in the same household of such individuals are not eligible. Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
2. CONTEST PERIOD: Contest begins on April 14, 2008 at 12:00:01 a.m. Eastern Time (ET) and ends on September 1, 2008 at 11:59:59 p.m. (ET).
3. TO PARTICIPATE AND SUBMIT ENTRIES:
No purchase necessary to enter the Contest. The GORE-TEX® Footwear Diamond in the Rough Contest challenges eligible participants to find a hidden GORE-TEX® Footwear game piece in each of the eight (8) participating destinations. To participate, visit the participating destination and search for the hidden game piece. Once the game piece is found, follow the instructions located on the contest piece no later than 11:59:59 p.m. (ET) on September 1, 2008 to claim the prize. Entrants can log on to the contest website at www.goretextravelfootwear.com to find photo clues and information about the locations of the hidden Diamonds in the Rough.
4. PRIZES: The first participant to find the hidden game piece in each participating destination and call the toll-free number located on the contest piece will win a $500 shopping spree for GORE-TEX® gear. Prizes may not be transferred, exchanged for cash or substituted, except by Sponsor, who reserves the right to substitute prize with prize of equal or greater value. Winner is solely responsible for all costs, incidentals, and any other expenses not specifically mentioned as being included. All federal, state and local taxes are sole responsibility of Winner.
Number of prizes to be awarded: 8; Approximate Retail Value of each prize: $500.00; Approximate Cumulative Retail Value of all prizes: $4,000.00. Sponsor reserves the right to award fewer than 8 prizes if 1) any number of game pieces remain hidden after the Contest End Date and/or 2) any winner fails to claim his or her prize by 11:59:59 p.m. (ET) on September 1, 2008. Odds of winning depend on the number of eligible participants.
5. GENERAL CONDITIONS: By participating, participants agree: (a) to these Official Rules; (b) that Sponsor, its subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (individually and collectively "Releasees") are released, will have no liability whatsoever for, and shall be held harmless by participants from and against any claim, damages or liability due to any injuries, losses or damages of any kind to any person, including death, or property of any kind, including intellectual property, or rights of publicity or privacy, defamation, or portrayal in a false light, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered or from participation in this Contest; (c) except where legally prohibited, to grant permission for Sponsor and those acting pursuant to Sponsor's authority to use, in perpetuity, his/her name, picture, voice and/or likeness, biographical information and statements and prize information, for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered world wide, and on the Internet and/or World Wide Web, without notice or review or approval; (d) to provide, upon request by Sponsor, proof of identity, address and birth date and/or to execute an affidavit of eligibility, liability release and, except where prohibited by law, a publicity release.
6. LIABILITY LIMITATIONS: Releasees are not responsible for a) lost, late, misdirected, incomplete, undelivered, damaged or illegible entries and all such entries will be void; b) interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), web site, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture, failure to capture or loss of entry or other information; c) injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the web site. Should any portion of the Contest be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to cancel or terminate the Contest, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor; and notice thereof will be posted on the web site. Releasees are not responsible for any incorrect or inaccurate information however caused. In case of dispute, the authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed to be the participant who must comply with these Official Rules. Persons who tamper with or abuse any aspect of this Contest, as solely determined by the Sponsor, will be disqualified.
No representation or warranty, written or oral, express or implied, in law or in fact is made for any prize except only that which may be made for that prize in the limited written warranty, if any, provided with that prize by the manufacturer of that prize.
